On November 7th, Du from Youxian District, Mianyang, Sichuan was knocked down and injured by a pet dog. Ms. Wang from nearby stepped forward to help send her to the hospital and paid 5,000 yuan in medical expenses in advance. Du spent tens of thousands of yuan in hospital for 20 days, so she sued Ms. Wang, who had advanced the medical expenses, to the court for compensation of 150,000 yuan. Ms. Wang said that the other party would retaliate for a favor, and the court also rejected Du's lawsuit.
The incident happened at around 8 o'clock in the evening on August 3, 2020. Ms. Wang, who lives in Youxian District, Mianyang, took her Labrador pet dog to a restaurant to meet friends. Because the dog has a gentle personality, Ms. Wang did not tie it on a leash. When she walked to the intersection of Xianquan Street and Longshan Road, she heard a woman shouting for help.

Ms. Wang quickly walked to the other party and helped dial 120 emergency number. The woman who fell to the ground was Du. She claimed to have been knocked to the ground by a dog and took two photos with her mobile phone, one was a Shiba Inu and the other was a half-length photo of a Labrador. After that, Ms. Du was rushed to the hospital for treatment.
Because Ms. Wang’s dog was not tied to a leash that night, she did not know whether her own dog hit the other party. After sending Du to the hospital, she paid 5,000 yuan in medical expenses in advance and asked Du which dog hit her. Du stayed in the hospital for more than 20 days and spent more than 26,000 yuan in medical expenses. After being discharged from the hospital, Du commissioned an appraisal and found that he had a tenth-level disability, and incurred lost work expenses, nursing and nutrition expenses, etc.

After receiving the appraisal opinion, Du sued Ms. Wang to the court for more than 150,000 yuan on the grounds that she was knocked down by Ms. Wang's dog. Faced with the unreasonable disaster, Ms. Wang was very angry. She said that there were two dogs that day. The one Ms. Du identified was a Shiba Inu, not the Labrador she raised. She advanced the medical expenses, but was sued without being thanked. She was very aggrieved.
During the trial, Ms. Wang also presented evidence that Ms. Wang and her colleagues visited Du in the hospital that day and asked which dog hit her. Du took out a photo of a yellow Shiba Inu to identify it and sent the picture of the Shiba Inu to Ms. Wang’s colleagues. Ms. Wang’s colleagues recorded the entire process.

The court held that although Ms. Du believed that the Labrador raised by Ms. Wang was the one who knocked her down, the evidence showed that Du had identified the Shiba Inu that knocked her down. Du’s statements were inconsistent and could not fully prove that his injuries were caused by the pet dog raised by Ms. Wang. He should bear the burden of proof, so Du’s claim was not supported.
Although the court finally ruled that Ms. Wang was not responsible, the whole thing was still quite infuriating. Du clearly knew which dog hit her, but instead falsely accused the person who helped him. What is the difference between such a claim and blackmail? It is too hateful to retaliate for kindness. If he knowingly committed the crime, he should be held legally responsible.

Some people say that Ms. Wang should be compensated for walking her dog without a leash. Ms. Wang being fined for not leashing and compensating Dum are two different things.
